3. Audience
The offer is intended exclusively for adult natural persons, acting for personal or family purposes, outside any professional activity.
No sales are offered to legal entities or professionals. No orders from minors are accepted.
4. Essential features of the offers
4.1 Personal Travel and Life project access, 12 months
The application offers two separate personal plans. Travel opens the Travel pathway described below. Life project opens the Life project pathway and includes Travel, without a separate purchase of the latter.
Each offer lasts twelve months from actual activation. For an already confirmed account, activation occurs upon payment confirmation. For a purchase without an account, it occurs after creating or signing in to a confirmed account using the purchase email address, when that purchase is linked. The end date can be viewed in the account. The twelve months are paid in one installment, without automatic renewal. No monthly debit is made. Article 10 specifies how access ends.
Previously acquired rights, including access for the duration of operations or access limited to one trip, are not converted into twelve-month access. They remain governed by the terms and scope accepted at purchase.
Included in Travel and Life project:
“I am planning a trip” pathway, for each trip the customer creates in the application:
- the areas of Costa Rica matching the information provided (duration, group composition, pace, interests, budget, transport), with the reasons and the sources supporting them;
- stages, selected places to stay and a distribution of nights;
- documented places according to the interests expressed, where available data allow it ;
- known constraints and caveats;
- a map and a travel journal that the customer can reorder, adjust and complete.
Included only in Life project, in addition to Travel:
- six regions presented using the same topics;
- guided field missions, organized into chapters, and a decision file;
- the library of resources and documented sources;
- the “Le Campement” community space;
- future additions, with no guaranteed frequency or volume.
Some partner resources may be featured in the application. They are optional, always identified by their status (Listed, Partner, Affiliate) and never required to progress. They are not sold by Levis Global LLC: any relationship with a partner is formed directly with them (article 7.3 of the Terms of Use).
The offer is a contract for continuing performance covering digital content and a digital service : immediate provision of the application, followed by continuous provision throughout the twelve months of the access purchased.
What Cap Ailleurs is not, and does not promise :
- neither a travel agency nor an organizer or retailer of travel or stays within the meaning of articles L211-1 et seq. of the French Tourism Code;
- nor a legal, tax, accounting or immigration firm; no legal, tax, accounting, immigration, medical or insurance advice is provided;
- no booking is made, no travel, accommodation or activity ticket is sold, and no real-time data (availability, price, schedule) are provided;
- no optimal itinerary, completeness, travel time or particular outcome is guaranteed; where the order of stages or travel times cannot be determined, the journal states this;
- no promise of expatriation, relocation, a residence permit, housing, employment or income.
Some information may be missing or undeterminable when the reliable data available are insufficient. The Service indicates this rather than filling the gap. The exact nature of the service and its limits are described in article 6 of the terms of use.
4.2 Family bonus: CANOPY by SLOWO e-book
When available, Cap Ailleurs access comes with a complimentary e-book (PDF file) from the children's collection CANOPY, published by SLOWO, a brand separate from Cap Ailleurs. This bonus is free : it is not part of the price and has no separate refund value.
It can be downloaded from the member area while Cap Ailleurs access is active, without differences according to country or payment currency. It is intended for personal and family use : distribution, resale or public availability are excluded. No physical medium is supplied or shipped. If Cap Ailleurs access ends, including after a full refund, downloading is no longer offered; a copy already downloaded is not reclaimed.
4.3 Cap Ailleurs Session (49 EUR, tax included)
The Cap Ailleurs Session is a 45-minute individual remote discussion, with a Cap Ailleurs founder, on the date and at the time chosen by the customer when booking. It helps review a travel or relocation project, prioritize questions and prepare next steps.
It constitutes neither legal, tax, accounting or immigration advice, nor the handling of formalities, nor a guarantee of results or relocation. Information exchanged is general and does not replace advice from a qualified professional.
Booking and payment take place through the scheduling tool Cal.com, which sends the confirmation and reminders.
5. Prices
The advertised amount is the total amount payable by the customer, tax included. The applicable price is that of the selected plan and currency, presented before confirmation. A subsequent price change does not alter the amount paid or the duration of access already purchased.
5.1 Personal access, prices for twelve months
| Offer | EUR | USD | CAD |
|---|---|---|---|
| Travel, 12 months | 49 EUR, tax included | 59 USD, tax included | 79 CAD, tax included |
| Life project, 12 months, Travel included | 99 EUR, tax included | 119 USD, tax included | 159 CAD, tax included |
The price is payable in one installment for the twelve months, without renewal or automatic debit. There is no personal monthly plan. On expiry, no new payment is triggered. A new purchase requires an explicit action and agreement by the customer at the price then presented.
The three amounts on the same row confer the same rights; the currency choice changes neither content nor duration. Any exchange fees applied by the customer's bank are not Cap Ailleurs fees. Additions included in the plan during its active period do not incur an automatic supplement.
5.2 Cap Ailleurs Session: 49 EUR, tax included
The price of the Cap Ailleurs Session is 49 EUR (forty-nine euros, all taxes included), payable upon booking, for one session.
6. Ordering
Cap Ailleurs. The ordering process follows these steps:
- presentation of the offer, its content and total price;
- express acceptance of these Terms of Sale;
- order summary and payment on Stripe's secure page, allowing the order to be checked and corrected before confirmation;
- confirmation constituting acceptance of the offer, price and these Terms of Sale;
- account creation or sign-in to an existing account, using the email address used for payment, followed by opening access.
An account may have been created before the order; it is not required to order. Until access is activated, the activation link can be requested again at any time from the “Find my purchase” page.
Cap Ailleurs Session. The customer selects a time slot on Cal.com, enters their contact details, accepts these Terms of Sale and pays; Cal.com confirms the booking.
No waiver of the right of withdrawal is requested during the Cap Ailleurs ordering process. No checkbox, statement or action is intended or has the effect of making the customer waive this right.
Order confirmation constitutes irrevocable acceptance, subject to any exercise of the right of withdrawal.
An order confirmation is sent by email: for Cap Ailleurs, by the Publisher, with the amount paid and the link to these Terms of Sale; for the Session, by Cal.com. Stripe separately sends the payment receipt and invoice. The accepted version of the Terms of Sale and its SHA-256 hash are logged.
The Publisher reserves the right to refuse a manifestly abnormal order, an order from a minor or professional, or from an account closed for breach.
7. Payment and access
Payment is processed by Stripe, Inc.. Levis Global LLC has no access to bank card data: these are collected and processed directly by Stripe.
Managed Payments. When this infrastructure is used, the transaction is processed through Stripe Managed Payments, and the payment page then indicates that the sale is made via Link, acting as merchant of record (merchant of record) according to Stripe's documentation. In this framework, Stripe/Link handles certain transactional, tax and payment support matters, issues receipts and invoices, and may issue refunds independently of the commercial policy described in article 8.7. This neither reduces nor conditions the customer's rights against Levis Global LLC under these Terms of Sale.
Payment for the Cap Ailleurs Session is collected by Levis Global LLC using Stripe, through the Cal.com booking tool.
The order becomes final upon actual receipt of payment. If authorization is declined, the order is deemed not concluded.
Cap Ailleurs access opens upon activation following payment confirmation. This immediate access in no way reduces the right of withdrawal described in article 8: the customer has full access during the fourteen days and can still withdraw and receive a full refund.
8. Right of withdrawal
8.1 Fourteen days, unconditionally
The customer has a period of fourteen calendar days to change their mind, from the day the contract is concluded, meaning payment confirmation (art. L221-18 of the French Consumer Code).
During this period, they may withdraw without giving a reason, without penalty and without fees. No reason is requested and no explanation is required.
If the fourteenth day falls on a Saturday, Sunday or public holiday, the period is extended to the next working day.
8.2 A full refund, regardless of previous use of the Service
If withdrawal is exercised within the period, the customer is refunded the full price paid.
This refund is full even if, in the meantime, the customer has :
- viewed all or part of the application;
- opened or downloaded field resources or library documents;
- used clarification and decision-making tools;
- joined Le Campement and posted there;
- built one or more trips, viewed their areas, places, sources and journal, or printed that journal;
- downloaded the complimentary e-book described in article 4.2.
No proportional deduction is applied. No amount is deducted for what has already been viewed or used.
8.3 No waiver requested for Cap Ailleurs
Access opens immediately after payment, but the customer is never asked to waive their right of withdrawal, either when ordering or afterwards. No checkbox of this kind exists in the purchase process.
Levis Global LLC waives reliance on the exception provided in article L221-28 of the French Consumer Code for digital content and fully performed services. The right of withdrawal therefore remains intact throughout the fourteen days despite immediate access.
This waiver applies to both pathways of Cap Ailleurs, and is made without needing to determine the exact classification of the Travel pathway (digital service, personalized digital content or mixed contract): whatever classification is adopted, the customer retains their fourteen days and full refund. Statutory exceptions and losses of rights apply only when their legal conditions are actually met, and Levis Global LLC does not invoke them for Cap Ailleurs.
Cap Ailleurs Session. The customer has fourteen days from booking to withdraw with a full refund, provided the session has not taken place. Where the customer expressly requests, when booking, that the session take place before the end of that period and acknowledges losing their right of withdrawal once the session is fully performed, that right can no longer be exercised after the session (article L221-28, 1° of the French Consumer Code). Outside the right of withdrawal, the session may be rescheduled or canceled free of charge up to 24 hours before the scheduled time, using the link in the Cal.com confirmation or by writing to contact@levisfamilyadventure.com ; later cancellation or non-attendance does not entitle the customer to a refund, except in cases of force majeure. If the Publisher cannot provide the session, the customer chooses between a new time slot and a full refund.
The mandatory statutory consumer protection provisions take precedence in all circumstances over the commercial policy described in article 8.7.
8.4 How to withdraw
The customer may exercise their right at their choice, by one of the following three means:
- the online withdrawal feature integrated into Cap Ailleurs, free of charge and identified by “Withdraw from the contract here”;
- the standard withdrawal form, made available to them, which the customer is not required to use;
- any other unambiguous statement expressing their wish to withdraw, sent to contact@levisfamilyadventure.com or by post to the address in article 2.
These three means remain available at all times. None replaces the others and the customer does not have to justify their choice. No particular format is imposed: a clear message is sufficient.
The online withdrawal feature is made available under article L221-21 of the French Consumer Code. It is free of charge, visible in the interface, directly and easily accessible, and available throughout the withdrawal period. It is identified by “Withdraw from the contract here”.
For the deadline to be met, the request need only be sent before the fourteen days expire. The sending date is decisive, not the processing date.
Whatever means is used, an acknowledgment of receipt is sent on a durable medium, reproducing the statement's content, date and time.
This online withdrawal feature is available. It is free, visible and directly accessible at the address https://capailleurs.levisfamilyadventure.com/retractation, throughout the withdrawal period. It collects or confirms the last name, first name, contract identification and an email address for the acknowledgment of receipt, includes an explicit confirmation step, and provides an acknowledgment of receipt on a durable medium reproducing the statement's content, date and time.
8.5 Refund timeframe and methods
The refund is made no later than fourteen days after receipt of the request for withdrawal.
It is made using the same payment method used for the order, unless the customer expressly agrees to another method, in which case without any cost to them.
8.6 Effect of withdrawal on access
Access to Cap Ailleurs, including the Campement and the bonus in article 4.2, is suspended on the effective date of withdrawal, then closed once the refund is made.
The customer's personal content can be retrieved upon simple request before closure.
8.7 After the fourteen days
Unless mandatory law provides otherwise, or a refund is made as part of Stripe/Link's processing of the transaction, the purchase of Cap Ailleurs is not covered by any voluntary commercial refund policy after the fourteen-day period. In particular, there is no commercial “satisfaction or your money back” guarantee.
Effect of a refund on access. When a refund in full is actually received, whatever its origin, the full access it had granted is revoked, including downloading the bonus in article 4.2. A refund in part does not trigger this revocation. The account and customer data are retained under other applicable provisions, in particular article 15 and the privacy policy.
This rule is without prejudice to :
- the statutory guarantee of conformity recalled in article 9;
- the statutory guarantee against hidden defects;
- the proportional refund due on cessation of operations under article 10;
- the refund due in cases of prolonged force majeure, article 14.
9. Statutory guarantee of conformity
Statutory guarantee of conformity for digital content and services. The consumer benefits from the statutory guarantee of conformity provided in articles L224-25-1 et seq. of the French Consumer Code.
As Cap Ailleurs is supplied continuously, the Publisher is liable for any lack of conformity arising throughout the entire supply period of the Service.
In the event of a lack of conformity, the consumer may require the Service to be brought into conformity, free of charge, within a reasonable time. If this is not achieved, they may obtain a price reduction or termination of the contract under the conditions provided by law.
These guarantees apply independently of any commercial guarantee and without prejudice to the statutory guarantee against hidden defects (art. 1641 et seq. of the French Civil Code).
The following do not constitute a lack of conformity:
- the development, reorganization or removal of content under article 7 of the Terms of Use, provided the Service's overall substance is preserved;
- the absence of additions during a given period, as no frequency is guaranteed;
- the appearance, development or removal of a partner resource, or the bonus in article 4.2 when not yet available;
- a temporary interruption for maintenance or a technical incident.
10. Access duration and cessation of operations
Travel and Life project, 12 months : the period starts on the actual activation date defined in article 4.1. The price is paid in one installment. On expiry, paid-plan features close; the free account remains available. No renewal or debit occurs without a new express order. The customer can view the end date in their account and retrieve personal content using the export tools available during the active period.
Earlier access rights. Access acquired under an earlier version remains governed by the text accepted at purchase, in particular access for the duration of operations and older access limited to one trip. Its duration is not shortened by the introduction of twelve-month plans.
If operations cease before the paid term ends, the Publisher informs Members at least three months in advance, maintains access during this notice where possible and allows retrieval of personal content. The customer retains the right to a proportional refund for the paid period not supplied, without prejudice to their statutory guarantees. The calculation uses the plan's twelve-month period and the price actually paid. The consequences of cessation for earlier access remain those under the terms accepted for that access.
11. Complaints
Any complaint must be addressed to contact@levisfamilyadventure.com. The Publisher undertakes to acknowledge receipt within five working days and provide a reasoned response within thirty days.
12. Consumer mediation
Any complaint concerning Cap Ailleurs services may be sent to the contact details in articles 2 and 11 of these terms, namely contact@levisfamilyadventure.com.
To date, Levis Global LLC has not appointed a consumer mediator.
This situation neither limits nor removes the consumer's rights and remedies under applicable mandatory law, including their right to bring proceedings before the competent court under article 17.
If a registered consumer mediator is appointed, their contact details will appear in this article and be communicated to customers on a durable medium. In that event, mediation would require a prior written complaint to the Publisher under article 11 and the dispute remaining unresolved for two months.
13. Liability
The Publisher is subject to an obligation to use reasonable efforts in providing the Service.
It guarantees no result, in particular no relocation or obtaining a residence permit, housing, employment or income in Costa Rica or elsewhere. No Service content amounts to an undertaking to that effect.
The liability limitations in article 14 of the Terms of Use apply, without depriving the consumer of the statutory guarantees recalled in article 9 hereof.
14. Force majeure
Neither party is liable for a breach resulting from force majeure within the meaning of article 1218 of the French Civil Code. If the impediment lasts longer than three months, either party may terminate the contract, and the Publisher then refunds the price portion corresponding to the period not supplied, calculated by the method in article 10.
15. Personal data
The processing of order and payment data is described in the privacy policy.
Billing data are kept for ten years under accounting obligations.
16. Evidence
The computerized records of the Publisher and its payment providers constitute evidence of orders, payments and their dates.
Acceptance of these Terms of Sale is logged with the version and SHA-256 hash.
17. Applicable law and disputes
These Terms of Sale are governed by French law, without prejudice to the mandatory protective provisions of the consumer's country of habitual residence (art. 6 of Regulation (EC) No 593/2008, known as Rome I).
If no amicable resolution is reached, the dispute may be brought before the competent court. The consumer may choose the court of their place of residence or the seller's place of establishment.
